Filariasis is considered a communicable disease because it can be transmitted from person to person through the bite of infected mosquitoes. Thus, the appeal is not allowed.
Who is responsible for paying for the appeal charges?
The management of foreign workers, including appeals, falls under the responsibility of the employer.
Why is appeal charges imposed for appeal registration?
To enhance the quality of service, we have collaborated with clinics to develop an appeal system that includes end-to-end monitoring. Additionally, we have standardized the appeal cost to ensure that employers are not subjected to excessive charges during the appeal processes.
How much are the appeal charges imposed for the appeal registration?
The appeal charge imposed is RM15 per disease.
Am I able to withdraw the case for appeal once it has been registered?
No, appeal case could not be withdrawn once registered. However, FOMEMA shall close the case as unsuccessful appeal if no additional test report received within 4 weeks from appeal registration.
Can we refund RM15 appeal charges if the worker wishes not to continue with the appeal process after an appeal has been
registered
No, the RM 15 is Non-refundable.
How do I make payment for the appeal registration?
Payment for the appeal registration shall be made online through the FOMEMA Online portal.
How are appeal registration charges calculated for my workers?
Appeal charges are calculated per disease. If your worker has multiple diseases, the charge imposed will be RM15 for each disease. For example, if there are two diseases the total appeal charges imposed will be RM30 (RM15 for each disease).
Is the appeal registration charges the same for all diseases?
Yes, it is RM15 for each disease.
How can I register an appeal for foreign worker?
An appeal can be initiated via the FOMEMA Online portal.
Are there any charges for the appeal process besides the registration of the appeal?
Yes, besides the registration of the appeal, there are additional charges for the appeal process. You are required to pay for the additional tests conducted for your foreign
worker during the appeal process via the FOMEMA Online portal. However, the payment method for additional tests is still in the development phase and is expected the be ready shortly.
Therefore, at this moment, payment for the additional test for the appeal case shall be paid directly to the respective appeal panel of clinics and hospitals. Payment for laboratory tests shall be made through the examining doctor at the appeal panel clinic. You may refer to the respective appeal panel of clinics and hospitals for details of fees for the additional tests in the appeal process.
How can I proceed with the payment for the additional test once the case has been registered for appeal?
Payment shall be made directly to the appeal panel clinics and hospital (which ever related). If there is new sample collection for the additional test (besides medical specialist investigations), laboratory fees shall be paid to the respective panel clinics.
Is there a specific appeal panel for the appeal process?
Yes. Normally, employers may go to the original clinic to proceed with the appeal process. However, in some cases, FOMEMA may appoint another clinic as an appeal panel for your foreign worker cases. Please check any instructions given in the FOMEMA Online portal. For cases that require specialist assessment, the appeal panel clinic is allowed to refer the case to the appointed appeal panel hospital only.
Where can I find the list of the FOMEMA appeal panel appointed for the appeal process?
Normally, the original clinic shall manage your appeal cases. However, another clinic may be appointed to manage your appeal cases. Please refer to the FOMEMA Online portal for any special instructions that need your attention.
Please be informed that for cases that require specialist assessment, the appeal panel clinic can only refer to the appeal panel hospital listed by FOMEMA. Please refer to the appeal panel clinic for details.
Can I select any FOMEMA appeal panel for the appeal process or one will be appointed for me?
Normally, you may go to an original clinic or in some cases the one appointed to you. Nevertheless, if you have any issues with the appeal panel clinic, you may send an email to cs@fomema.com.my. Please be reminded that it is best to call the clinic and make an appointment before proceeding with the appeal process.
Can I change my FOMEMA appeal panel once I have selected them?
No. Employers are not allowed to change the appeal panel. You may go to the original clinic or clinic appointed to you. Nevertheless, if you have any issues with the appeal panel clinic, you may send an email to cs@fomema.com.my.
Can a non-FOMEMA panel be listed as a FOMEMA appeal panel?
No. Non-FOMEMA panel will not be listed as an appeal panel.
Is there any allocated quota for the FOMEMA appeal panel?
No. There is no allocated quota for the FOMEMA appeal panel.
Can we proceed to refer to the FOMEMA registered medical clinic once the case has been registered as an appeal?
Once appeal registration has been made and paid via the FOMEMA Online portal, the employer may proceed to the original clinic or in some cases to another clinic appointed to you. Please call the relevant clinic and make an appointment before coming for the appeal process.
