Registered employers who wish to appeal for their foreign worker who fails the initial medical examination must submit the application within two (2) weeks from the certification date.
CASES NOT ALLOWED TO APPEAL
Tuberculosis (TB)
Audit of initial chest X-ray image by Panel Consultant Radiologist of FOMEMA confirms the present of radiological signs of TB.
Malaria
Malaria screening test result was positive and confirmed with BFMP test as malaria parasite present.
Pregnancy
Urine pregnancy test result was positive and confirmed with serum β-hCG test result as positive.
Note: β-hCG = Beta-Human Chorionic Gonadotropin
Sexually Transmitted Diseases (Syphilis)
VDRL test result was reactive and confirmed with TPHA test result as positive.
HIV
HIV 1 & 2 Ab was reactive during FOMEMA Medical Examination.
Hepatitis B
HBsAg was reactive during FOMEMA Medical Examination.
Hepatitis C
Anti-HCV was reactive during FOMEMA Medical Examination.
Filariasis
Filariasis screening was positive during FOMEMA Medical Examination.

For a case allowed to appeal, the employer will be notified via email advising them to submit an appeal within two (2) weeks from the certification date.
Registration of appeal can be done either through Employer/ Agency Portal at the portal.fomema.my
Employer / Agency can monitor the progress of the appeal case via respective Employer Portal at the portal.fomema.my.
All appeal cases will be resolved soonest possible once the documents are completed, and the case will be closed if no documents are received after 4 weeks.

Additional Tests – All additional test results must be submitted to FOMEMA soonest possible. The case will be closed if no document is received after 4 weeks. Kindly refer “Appeal To Do List” for the list of additional test.
Check Appeal Status – The status of the appeal can be monitored from the Employer Portal at the portal.fomema.my. the Appeal decision letter is available for download if necessary.
