Appeal Procedure

Registered employers who wish to appeal for their foreign worker who fails the initial medical examination must submit the application within two (2) weeks from the certification date.


CASES NOT ALLOWED TO APPEAL

Chest X-Ray abnormal and audited by FOMEMA (XQCC) as Tuberculosis (Chest X-Ray abnormal)

Malaria Blood reactive and confirmed with BFMP as positive on a primary blood sample

Urine Pregnancy Test (UPT)
positive in urine and confirmed with serum BETA-HCG as positive on a primary blood sample

VDRL test reactive and confirmed with TPHA as positive on a primary blood sample

HIV test reactive or positive during FOMEMA Medical Examination

For a case allowed to appeal, the employer will be notified via email advising them to submit an appeal within two (2) weeks from the certification date.

Registration of appeal can be done either through Employer/ Agency Portal at the portal.fomema.my 

Employer / Agency can monitor the progress of the appeal case via respective Employer Portal at the portal.fomema.my.

All appeal cases will be resolved soonest possible once the documents are completed, and the case will be closed if no documents are received after 4 weeks.

Register Appeal – Employer/ Agency may register the appeal via Employer / Agency Portal at portal.fomema.my.

Additional Tests – All additional test results must be submitted to FOMEMA soonest possible. The case will be closed if no document is received after 4 weeks. Kindly refer “Appeal To Do List” for the list of additional test.

Check Appeal Status – The status of the appeal can be monitored from the Employer Portal at the portal.fomema.my. the Appeal decision letter is available for download if necessary.
